Please read these Terms of Use carefully before using the EquipPay platform. By accessing or using EquipPay — whether as a supplier, buyer, or visitor — you agree to be bound by these terms. If you do not agree, please do not use the platform.

1. About EquipPay

EquipPay is an equipment finance technology platform operated by Lyft Capital Pty Ltd (ABN: 18 623 527 775), an Australian Credit Licence (ACL 541052) (ACL) holder based in Sydney, New South Wales, Australia.

EquipPay connects equipment suppliers and their customers with a panel of 50+ lenders to facilitate equipment finance applications. EquipPay is a technology intermediary — it is not itself a lender and does not provide credit.

These Terms govern your use of the EquipPay website, widget, and any related services (collectively, the "Platform").

2. Supplier Terms

Suppliers are businesses that embed the EquipPay widget on their website to offer embedded finance to their customers. By participating as a supplier, you agree to:

Suppliers must not represent themselves as a lender or credit provider, or imply that finance approval is guaranteed. All finance decisions are made independently by lenders.

Buyers are individuals or businesses submitting finance applications through the EquipPay platform. By submitting an application, you acknowledge that:

EquipPay pays referral fees to participating suppliers when a finance application submitted through their embedded widget results in a settled deal.

Referral fee arrangements may be required to be disclosed to customers under applicable credit laws. Suppliers are responsible for making any required disclosures.

5. Intellectual Property

The EquipPay Platform, including the widget, brand assets, logo, wordmarks, software, design, and all associated content, is owned by Lyft Capital Pty Ltd and is protected by Australian and international intellectual property laws.

6. Limitation of Liability

EquipPay is a technology platform that facilitates connections between borrowers and lenders. It is not a lender, credit provider, or financial adviser.

7. Termination

EquipPay reserves the right to suspend or terminate access to the Platform at any time, with or without notice, in the following circumstances:

Suppliers who terminate or are terminated must remove all EquipPay widget embed code from their website and cease using EquipPay branding. Where a Supplier Agreement applies, its specific termination provisions (including notice periods and widget removal obligations) govern.

EquipPay reserves the right to update these Terms at any time. The updated version will be published at this URL with a revised last-updated date. Continued use of the Platform after changes are published constitutes acceptance of the updated Terms.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts of New South Wales.
